Florida Local Counsel for Trademark and Lanham Act Litigation

For IP litigators and in-house counsel outside Florida with a case filed, or about to be filed, in a Florida federal court. We serve as local counsel in the Southern and Middle Districts of Florida, at the courthouses in Miami, Fort Lauderdale, West Palm Beach, Fort Pierce, Key West, Orlando, Tampa, and Fort Myers, and we know the substance as well as the procedure.

The courts

Eight federal courthouses, two districts

The Southern District of Florida sits in five divisions, from Key West to Fort Pierce, and Miami is its main courthouse. The Middle District's Orlando, Tampa, and Fort Myers divisions cover Central and Southwest Florida. Together the eight courthouses on this page house 30 active district judges, 17 senior district judges, and 37 magistrate judges.

Admission rules

Why Florida cases need local counsel

The rules differ by court. In the Southern District, local counsel is a requirement; in the Middle District, it is a practical advantage.

CourtLocal counsel required?Key facts
S.D. FloridaMiami, Fort Lauderdale, West Palm Beach, Fort Pierce, Key WestYesPro hac vice under Rule 4(b) of the court's Special Rules Governing the Admission and Practice of Attorneys. The motion is filed and served by co-counsel admitted in the district, who must consent in writing and is designated to receive service. Lawyers admitted pro hac vice cannot e-file, so local counsel files every paper. Fee: $250 per attorney, per case. More than three pro hac vice motions in separate cases within 365 days is presumed to be a general practice.
M.D. FloridaOrlando, Tampa, Fort Myers (and Jacksonville, Ocala)NoSpecial admission under Local Rule 2.01(c) for a lawyer who is not a Florida Bar member but is admitted in a U.S. district court, with a list of Florida cases from the last 36 months. Fee: $150. Local counsel is not required, but co-counsel with e-filing rights can file the motion, and local practice knowledge matters.
Florida state courtsCircuit and county courts statewideYesFlorida Rule of General Practice and Judicial Administration 2.510 requires association with a Florida Bar member as attorney of record, a verified motion, and a fee to The Florida Bar. More than three appearances in separate matters within 365 days is presumed to be a general practice of law in Florida.
Our role

What we handle as local counsel

Our attorneys are members of the bars of the Southern and Middle Districts of Florida and work from Miami. We file, serve, and appear, and because trademark and Lanham Act cases are our core practice, we can step into the substance when you need us to.

  • Pro hac vice and special admission motions, with written consent to designation
  • CM/ECF filing and service of every paper
  • Local-rule and judge-specific procedure review before each filing
  • Hearing, mediation, and deposition coverage in South and Central Florida
  • Emergency TRO, seizure, and asset-freeze filings, including after-hours coordination
  • Courtesy copies, chambers procedures, and calendar monitoring

Scope and responsibility

Local counsel signs and files, and answers to the court for what it files. We review every filing for local-rule and judge-specific compliance before it goes in, and our engagement letter sets out exactly what we do and do not do.

How the engagement works

  1. Conflict checkParties, court, case number, deadline.
  2. Engagement letterDefines the local-counsel role, turnaround times, and fees.
  3. AdmissionWe file the pro hac vice or special admission motion.
  4. Filing protocolAgreed lead times for drafts and our compliance review.

Questions from counsel

Frequently asked questions

Is local counsel required in the Southern District of Florida?

Yes, for a lawyer appearing pro hac vice. Rule 4(b) requires a motion filed and served by co-counsel admitted in the district, who consents in writing to the designation and files every document electronically, because lawyers admitted pro hac vice cannot use CM/ECF.

Is local counsel required in the Middle District?

No. A lawyer admitted in a U.S. district court can move for special admission under Local Rule 2.01(c) and pay the $150 fee. Many firms still use local counsel for filing, hearings, and knowledge of division and judge practices.

How fast can you take on a matter?

Send the parties, court, case number, and deadline through the conflict-check form. We aim to clear conflicts within one business day and can file a pro hac vice motion soon after engagement.

What does local counsel answer for?

Local counsel signs and files, and answers to the court for what it files. We review each filing for local-rule compliance before it goes in, and our engagement letter defines the role and responsibilities in writing.

Do you cover hearings outside Miami?

Yes. We cover hearings, mediations, and depositions at each courthouse on this page, from Key West to Orlando.

How are local counsel fees structured?

Flat or per-filing fees are available for defined local-counsel roles, and hourly rates for substantive work. We confirm the structure in the engagement letter.

Send the parties, court, case number, and your deadline. We aim to clear conflicts within one business day. Sending this form does not create an attorney-client relationship.
